These terms apply to everyone who uses FairStay, whether you're a guest, a host, or both.

1. 1.Agreement

   These Terms of Service are a binding agreement between you and FairStay ("we", "us") covering your use of the FairStay website and services. By creating an account or using FairStay, you agree to them.

2. 2.Additional terms

   Guests also agree to the Guest Terms each time they request a booking, and hosts also agree to the Host Agreement when they turn on hosting. Both are part of these Terms. If they conflict with these Terms, the Guest Terms or Host Agreement apply to that topic.

3. 3.Accounts

   You must be 18 or older, sign in with your own Google account, and keep your profile accurate. You are responsible for activity on your account. Tell us right away if you think it has been misused.

4. 4.Fees

   Guests pay no FairStay service fee: the total shown before payment is the total charged. Hosts pay a flat 10% commission on each booking, as described in the Host Agreement. Payments are processed by Stripe and are also subject to Stripe's terms.

5. 5.Acceptable use

   Don't break the law, post false or misleading listings or reviews, harass or discriminate against anyone, arrange payments outside FairStay, upload content you don't have rights to, scrape or overload the service, or try to get around our security. All users must follow the Non-discrimination Policy.

6. 6.Content

   You keep ownership of what you post. You give FairStay a non-exclusive, royalty-free license to host, show and use it to operate and promote the platform. We may remove content that breaks these Terms.

7. 7.Privacy

   Our Privacy Policy explains how we collect, use, share and protect your information.

8. 8.Suspension and termination

   You can close your account at any time, after honoring any confirmed stays. We may suspend or close accounts that break these Terms or our policies, or that create safety, fraud or legal risk.

9. 9.Disclaimers and liability

   FairStay is provided "as is". FairStay is a marketplace and is not a party to rentals between hosts and guests. To the fullest extent the law allows, FairStay is not liable for indirect or consequential damages. Our total liability is limited as described in the Guest Terms and Host Agreement, or to $100 if neither applies.

10. 10.Disputes and governing law

    Contact us first at Vegasvacation1337@gmail.com. Disputes are resolved by binding individual arbitration, as described in the Guest Terms and Host Agreement, and these Terms are governed by the laws of Nevada.

11. 11.Changes

    We may update these Terms. If a change is important, we will tell you in the app, and continuing to use FairStay after it takes effect means you accept the updated Terms.
