FairStay

Host Agreement

Version 2026-06 · FairStay · 9452 Silvaner Ct, Las Vegas, NV 89123 · Vegasvacation1337@gmail.com

Please read this before you host. It explains what you can expect from FairStay and what FairStay and your guests can expect from you.

  1. 1.About this agreement

This Host Agreement is a binding contract between you and FairStay ("we", "us"). You accept it by ticking the agreement box when you turn on hosting. We keep a record of the version you accepted, the date and time, and the device you used. If we update this agreement, you must accept the new version before you can keep accepting bookings.

  2. 2.FairStay's role

FairStay is an online marketplace that connects hosts and guests. We are not a party to the rental between you and your guest, and we are not a real estate broker, travel agent, insurer or property manager. You run your hosting as an independent business. You are not an employee, agent or partner of FairStay.

  3. 3.Your right to list

You confirm that you are at least 18, and that you own the home or have written permission from the owner, landlord or HOA to rent it short-term. You also confirm that short-term renting is allowed under all laws, permits, zoning rules, leases and HOA rules that apply to it. You are solely responsible for this. Our review of your permit is a basic check only. It is not a guarantee or legal opinion that your listing is lawful.

  4. 4.Insurance (required)

You must keep an active short-term rental insurance policy covering guest bodily injury and property damage, with at least $1,000,000 liability per occurrence. You must upload current proof of it. If your policy expires, your listing is hidden automatically until you upload new proof. FairStay does not provide insurance to hosts or guests and does not guarantee that any claim will be paid. Where your insurer allows it, we ask that you name FairStay as an additional insured.

  5. 5.Fees and payouts

FairStay charges you a commission of 10% of each booking total (the nightly price times the nights, plus your cleaning fee). Guests pay no FairStay service fee. Guests pay you directly through Stripe, FairStay's payment processor, into the Stripe account you connect on your Payouts & Store page, and you are the seller for those payments. FairStay's commission is deducted automatically at the time of payment. Stripe charges its processing fees to your Stripe account and pays out your balance on your Stripe payout schedule. You must finish Stripe onboarding before you can accept bookings. If a guest is refunded, the refund comes out of your Stripe account and FairStay returns the matching share of its commission.

  6. 6.Taxes

You are responsible for your income taxes and for any occupancy, lodging or tourist taxes on your bookings, unless FairStay tells you in writing that it collects a tax for your area. Where the law requires it, we may report your payouts to tax authorities.

  7. 7.Accurate listings and safety

Your listing, photos, amenities, price and house rules must be accurate and kept up to date, and you must have the right to use every photo. The home must have working smoke and carbon monoxide detectors and a fire extinguisher. Recording devices are never allowed in bedrooms or bathrooms. Any camera or noise monitor anywhere else must be disclosed in the listing. You must disclose hazards such as pools, hot tubs, steep stairs or water access.

  8. 8.Non-discrimination

You must follow the FairStay Non-discrimination Policy. You may accept or decline a guest only based on their stay history, reviews from other hosts, dates, group size and your house rules. Every decline needs a reason from our list. Breaking this policy can lead to immediate suspension or removal.

  9. 9.Bookings and cancellations

You may accept or decline each booking request. Once a guest has paid, you may cancel only for genuine emergencies outside your control. If you cancel a paid stay, the guest gets a full refund, and we may suspend you, especially if it happens repeatedly.

  10. 10.Guest conduct and damage

Guests must follow your house rules and the FairStay Guest Terms, and they are responsible for damage they cause beyond normal wear and tear. You can report damage within 14 days of checkout, with photos and receipts. We will help you request payment from the guest. Unless a separate protection program applies, FairStay does not guarantee that you will recover the money, and your insurance remains your main protection.

  11. 11.Complaints and refunds

If a guest complains, you will be notified and can reply with your own statement and photos. FairStay backs the host unless the guest's evidence clearly supports the complaint. Our decision on any refund paid through FairStay is final within the platform. Refunds, including cancellation refunds under the guest cancellation policy (full refund 14 or more days before check-in, 50% at 7 to 13 days, none within 7 days), come out of your Stripe account, and FairStay returns the matching share of its commission. Stripe does not return its card processing fee when a payment is refunded, and that fee is a cost of hosting that you cover.

  12. 12.Your content

You keep ownership of your photos and text. You give FairStay a non-exclusive, royalty-free, worldwide license to use them to run and promote the platform while your listing is active and for a reasonable time afterwards.

  13. 13.Guest information and off-platform deals

You may use a guest's information only for their booking. You may not ask a guest you met on FairStay to book or pay outside FairStay for 12 months after their last request. Doing so can lead to removal and recovery of the commission we lost.

  14. 14.Suspension and termination

You can stop hosting at any time, but you must honor stays that are already confirmed. FairStay may suspend or remove you or any listing if you break this agreement, the law or our policies, or if we reasonably believe there is a safety risk or fraud.

  15. 15.Disclaimers

The platform is provided "as is" and "as available". FairStay does not guarantee any number of bookings, any income or any guest's behavior. We do verify guest emails, but we do not run background checks unless we say otherwise.

  16. 16.Limitation of liability

To the fullest extent the law allows, FairStay is not liable for indirect, incidental, special or consequential damages, or for lost profits or data. FairStay's total liability to you for any claim is limited to the greater of the commissions you paid us in the 12 months before the claim or $100. Nothing here limits liability that cannot legally be limited.

  17. 17.Indemnification

You will defend, indemnify and hold harmless FairStay and its owners, employees and agents against any claims, losses, fines, taxes and legal fees arising from your listing, your property, your hosting, your breach of this agreement, or your breach of any law or third-party right.

  18. 18.Disputes and arbitration

Before filing a claim, you agree to contact us at Vegasvacation1337@gmail.com and try to resolve it informally for 30 days. If that fails, any dispute will be settled by binding individual arbitration administered by the American Arbitration Association, except that either side may use small claims court. You and FairStay waive any right to a jury trial or class action. You may opt out of arbitration by emailing us within 30 days of first accepting this agreement.

  19. 19.Governing law

This agreement is governed by the laws of Nevada, without regard to its conflict-of-law rules.

  20. 20.General

If any part of this agreement is found unenforceable, the rest stays in effect. This agreement, together with the policies it mentions, is the whole agreement between us on hosting. You may not transfer it. If we don't enforce a term right away, we have not waived it. Notices to FairStay go to 9452 Silvaner Ct, Las Vegas, NV 89123 or Vegasvacation1337@gmail.com.
