Guest Terms
Version 2026-06 · FairStay · 9452 Silvaner Ct, Las Vegas, NV 89123 · Vegasvacation1337@gmail.com
These terms apply every time you request or book a stay on FairStay.
1.About these terms
These Guest Terms are a binding contract between you and FairStay ("we", "us"). You accept them by ticking the agreement box when you request a booking. We keep a record of the version you accepted, the date and time, and the device you used. Your stay itself is an agreement between you and the host.
2.FairStay's role
FairStay is a marketplace. Hosts are independent and responsible for their homes. FairStay does not own, manage or inspect listings, and does not guarantee that a listing is safe, accurate or suitable.
3.Eligibility and your group
You must be at least 18 and keep your profile accurate. The person who books is responsible for everyone in their group and every visitor they invite.
4.Booking and payment
You send a request, and once the host accepts, you pay by card through FairStay. The total shown before you pay is everything FairStay charges you: the nightly price, the host's cleaning fee and any taxes we are required to add. There is no FairStay service fee. Paying FairStay counts as paying the host.
5.House rules
The host's house rules shown when you request a booking are part of your agreement. You must respect the maximum number of guests, quiet hours and any rules on smoking, pets and parties. For serious violations, the host may ask you to leave, with FairStay's review. Stays ended because of your violations are not refunded.
6.Damage
You are responsible for damage you or your group cause beyond normal wear and tear. A host may report damage within 14 days of checkout with evidence. You will be told about the claim and can respond. You agree to pay amounts that are fairly determined through FairStay's damage claim process.
7.Cancellations and refunds
You can cancel a request for free at any time before you pay. After you pay, you can cancel the stay yourself from your Trips page: you get a full refund if you cancel 14 or more days before check-in, a 50% refund if you cancel 7 to 13 days before, and no refund within 7 days of check-in. You also get a full refund if the host cancels, and refunds for problems during a stay go through FairStay's complaint process. Refunds go back to the card you paid with, usually within 5 to 10 business days.
8.Problems during your stay
If something is wrong, report it as soon as you can, ideally within 24 hours, using "Report a problem" on your trip. Add clear photos and a description. The host can respond. Our team reviews both sides and decides based on the evidence, and any refund goes back to the card you paid with.
9.Your own risk
Homes may have features such as pools, hot tubs, stairs, fireplaces, water access, animals or outdoor equipment. You use them at your own risk and are responsible for supervising children. FairStay recommends travel insurance.
10.Respect and prohibited conduct
Treat hosts and their homes with respect. Don't pay or book outside FairStay for a home you found here, use a home for anything illegal, throw parties that aren't allowed, or give false information. Breaking these rules can lead to removal from FairStay.
11.Disclaimers and limitation of liability
The platform is provided "as is". To the fullest extent the law allows, FairStay is not liable for indirect or consequential damages, or for injury, loss or damage caused by a host, a home or another person. FairStay's total liability to you is limited to the greater of the amount you paid through FairStay for the booking in question or $100. Nothing here limits liability that cannot legally be limited.
12.Indemnification
You will indemnify and hold harmless FairStay and the host against claims, losses and legal fees caused by your breach of these terms, the house rules or the law, or by damage your group causes.
13.Disputes and arbitration
Contact us first at Vegasvacation1337@gmail.com, and we will try to resolve the issue informally for 30 days. After that, disputes go to binding individual arbitration administered by the American Arbitration Association, except for small claims court. You waive any jury trial or class action. You can opt out by emailing us within 30 days of first accepting these terms. These terms are governed by the laws of Nevada.
14.General
If any part of these terms is unenforceable, the rest stays in effect. These terms and the policies they mention are the whole agreement between you and FairStay. We may update them, and new bookings will need the current version.
